well, as most people use icons made by icon-makers for anyone who wants to use them, it's natural to assume, when looking at someone's userpics, that as long as they credit the original maker it's ok to use the icon. i don't mind putting 'please do not take' on some of the icons i use, if they're just for me - it's when people take them anyway that there's a problem.
